本利用規約（以下「本規約」といいます）は、SketchMapアプリケーション（以下「本アプリ」といいます）を利用する際の条件を定めたものです。日本語版と英語版に矛盾がある場合、日本語版を優先するものとします。
第1条（本アプリの概要）
1. 本アプリは、OpenStreetMapの地図データを利用し、地図上に自由に描画する機能を提供するモバイルアプリケーションです。
2. ユーザーの現在地情報は、Geolocatorライブラリを用いて取得し、地図上に表示することができます。
第2条（OpenStreetMapデータの使用）
1. 本アプリは、OpenStreetMapプロジェクトが提供する地図データを利用しています。
2. ユーザーは、OpenStreetMapの利用規約およびデータライセンスを遵守するものとします。
3. 本アプリでは、OpenStreetMapデータの精度や完全性について保証しません。地図情報の利用に伴う結果は、すべてユーザーの責任において行われるものとします。
第3条（位置情報の取り扱い）
1. 本アプリでは、Geolocatorライブラリを利用してユーザーの位置情報を取得します。
2. 取得した位置情報は、以下の目的で利用します。
- ユーザーの現在地を地図上に表示するため
- 地図描画機能をサポートするため
3. ユーザーの位置情報は、事前の同意なく第三者に提供されることはありません。ただし、以下の場合を除きます。
- 法令に基づく開示が必要な場合
- 生命、身体、財産の保護が必要であり、本人の同意を得ることが困難な場合
4. 位置情報の取得は、ユーザーが端末設定で位置情報の利用を許可した場合に限ります。位置情報取得を無効化することで、本機能の一部が利用できなくなる場合があります。
第4条（禁止事項）
ユーザーは、本アプリの利用にあたり、以下の行為を行ってはなりません。
- 本アプリの機能を不正に利用する行為
- 他のユーザー、第三者、または当社の権利を侵害する行為
- 本アプリの解析、改変、逆コンパイル、リバースエンジニアリング等の行為
- 法令または公序良俗に反する行為
- その他、当社が不適切と判断する行為
第5条（免責事項）
1. 本アプリは、可能な限り正確な情報を提供するよう努めますが、その内容について保証するものではありません。
2. 本アプリの利用に伴い発生した損害（データ損失、位置情報の誤差、描画ミス等）について、当社は一切の責任を負いません。
3. ユーザーの通信環境や端末の不具合により発生した問題についても、当社は責任を負いません。
第6条（アプリの変更、停止、終了）
1. 当社は、事前の通知なく、本アプリの機能やサービス内容を変更、停止または終了することがあります。
2. 本アプリの変更、停止、または終了に伴いユーザーに損害が生じた場合でも、当社は一切責任を負いません。
第7条（規約の変更）
1. 当社は、必要に応じて本規約を変更することができます。
2. 本規約の変更は、本アプリ内またはストアの更新情報にて通知し、その通知日から効力を有するものとします。
3. ユーザーが変更後も本アプリを利用する場合、変更後の規約に同意したものとみなします。
第8条（準拠法および裁判管轄）
1. 本規約は、日本法に準拠します。
2. 本規約に関する一切の紛争については、横浜地方裁判所を専属的合意管轄裁判所とします。
本規約に同意いただけない場合、本アプリの利用をお控えください。
English Version
These Terms of Use (hereinafter referred to as "Terms") set forth the conditions for using the mobile application SketchMap (hereinafter referred to as "the App"). In case of any discrepancies between the Japanese and English versions of these Terms, the Japanese version shall prevail.
Article 1 (Overview of the App)
1. The App is a mobile application that uses OpenStreetMap data to provide map display and drawing functionalities.
2. The App acquires the user’s current location using the Geolocator library and displays it on the map.
Article 2 (Use of OpenStreetMap Data)
1. The App utilizes map data provided by the OpenStreetMap project.
2. Users must comply with OpenStreetMap's Terms of Use and Data License.
3. The App does not guarantee the accuracy or completeness of OpenStreetMap data. All use of map information is at the user's own responsibility.
Article 3 (Handling of Location Information)
1. The App uses the Geolocator library to acquire the user’s location information.
2. Location information is used for the following purposes:
- Displaying the user’s current location on the map.
- Supporting the map drawing functionality.
3. Location information will not be shared with third parties without the user’s prior consent, except in the following cases:
- When required by law.
- When necessary to protect the life, body, or property of a person and obtaining the user’s consent is difficult.
4. Location information is only acquired when the user grants location permission through the device settings. Disabling location permissions may limit certain features of the App.
Article 4 (Prohibited Conduct)
Users are prohibited from engaging in the following activities while using the App:
- Improper use of the App’s features.
- Infringing on the rights of other users, third parties, or the developer.
- Analyzing, modifying, reverse engineering, or decompiling the App.
- Violating laws or public order and morality.
- Any other actions deemed inappropriate by the developer.
Article 5 (Disclaimer)
1. The App strives to provide accurate information but does not guarantee the reliability or accuracy of its content.
2. The developer is not responsible for any damages incurred through the use of the App, including data loss, location inaccuracies, or drawing errors.
3. The developer is also not responsible for issues arising from network or device failures on the user’s side.
Article 6 (Changes, Suspension, and Termination of the App)
1. The developer reserves the right to change, suspend, or terminate the features or services of the App without prior notice.
2. The developer is not liable for any damages incurred by users due to changes, suspension, or termination of the App.
Article 7 (Changes to the Terms)
1. The developer may amend these Terms as necessary.
2. If these Terms are amended, the updated Terms will be displayed within the App or through the app store’s update details and will take effect from the date of notification.
3. Continued use of the App after the notification constitutes acceptance of the changes.
Article 8 (Governing Law and Jurisdiction)
1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Yokohama District Court.
If you do not agree to these Terms, please refrain from using the App.
